Tisha M. Gargon’s indictment was dismissed in a pre-trial motion hearing over the objection of prosecutors, the Salem County Prosecutor's Office said.
Gargon, 51, of Pittsgrove Township, had been indicted in October 2022 on charges of endangering the welfare of a child in the fatal crash,
She gave an unlicensed 16-year-old “permission to access and drive the vehicle" on May 3, 2022, according to a criminal complaint
Schalick High School student Evan D’Anjou, 15, was killed, and the driver seriously hurt in the crash at the intersection of McKishen and Buck roads in Pittsgrove.
"Although we disagree with the result, we do not anticipate filing an appeal of the decision," said Jeffrey J. Barile, a spokesman for the Salem County prosecutor. "We continue to consider all available options and remain committed to seeking justice in this matter."
